# Terms & Conditions

These Terms govern your access to and use of SolProbe — the SolProbe API at `api.solprobe.xyz`, the brand site at `solprobe.xyz`, the [OpenClaw skill](/access-paths/openclaw-skill.md), the [Virtuals ACP](/access-paths/virtuals-acp.md) listing, and any other surface we publish (collectively, the **Service**). By calling a paid endpoint, signing an `X-PAYMENT` permit against our wallet, or escrowing through our ACP listing, you agree to these Terms.

If you don't agree, don't call the Service.

## 1. What SolProbe is

SolProbe is a **pay-per-call Solana token risk scanner** and a **Mode-A BYOW swap executor**:

* **Scanners** (`/scan/quick`, `/market/intel`, `/scan/deep`) read live on-chain and off-chain data and return structured JSON — an A–F structural-safety grade, a BULLISH/BEARISH/NEUTRAL market signal, or an adversarial deep-dive with a BUY/AVOID/WATCH/DYOR recommendation.
* **Swap executor** (`/trade/quote` + `/trade/execute`) returns an unsigned Solana transaction routed through Jupiter for you to sign locally, then broadcasts the signed bytes. **SolProbe never holds your private key.**

The Service is live and actively developed. Features, prices, and response shapes may change; breaking changes will be reflected in `schema_version`.

## 2. Risks and your responsibilities

You acknowledge the risks of using an early-stage, agent-facing, on-chain service:

**a. Software risk.** The Service is actively developed; bugs, scanner blind spots, stale data, and partial outages can happen. We degrade gracefully (`data_quality: "PARTIAL" | "LIMITED"`) where we can, but we don't guarantee uninterrupted service.

**b. On-chain risk.** Calling SolProbe involves real blockchain interaction:

* **Base payments** (`eip155:8453`) are EIP-3009 `transferWithAuthorization` USDC permits to our payment wallet `0x8D2460E139a8BE2fdB72a44a52bc494F7326adfC`. Gas is sponsored by a facilitator.
* **Solana payments** (`solana:5eykt4U…`) are SPL USDC transfers to our payment wallet `FQ3VL8vv8niMMJRY6SVGw6wgJ8bbs5WstN9fK2d6cAc9`. Fees are paid by a facilitator.
* **Swap execution** signs and broadcasts a Solana transaction built by [Jupiter](https://jup.ag). Slippage, MEV, failed routes, partial fills, and price impact are real risks. The risk gate runs in `/trade/quote` and you can reject before signing — once signed and submitted, the transaction is yours.

**c. Scanner limitations.** Structural-safety grading is deterministic and reproducible; the deep-dive includes adversarial signals (clustering, wash trading, dev wallet history) computed from third-party data sources that may be incomplete or stale. A grade of "A" is **not a guarantee that a token is safe** — it means no known structural vector is present at scan time.

**d. AI narrative summaries.** Human-readable summary fields (e.g. `summary`, `full_risk_report`) are generated by a language model. Determined fields (`structural_risk_grade`, `risk_breakdown`, `factors[]`, `recommendation.action`, etc.) are computed in scanner code, not by the LLM. Trust the deterministic fields; verify the narrative.

**e. Test with small amounts.** When connecting a new wallet or a new agent, run one `/scan/quick` ($0.02) first to verify the round trip before you wire up a budget. Do not put more in a wallet than you can afford to lose.

**f. Wallet security.** You are solely responsible for your private keys, seed phrases, and signing infrastructure. We never see them.

## 3. Third-party services

SolProbe is composed of third-party building blocks:

* **Facilitators** — Coinbase Developer Platform (CDP) for x402 settlement on both Base and Solana.
* **Data sources** — multiple Solana on-chain RPC providers and market data APIs. Field provenance is tracked per response; see [Discovery & identity](/reference/discovery-and-identity.md).
* **Swap routing** — [Jupiter](https://jup.ag) for `/trade/quote` and `/trade/execute`.
* **Channels** — [Virtuals Protocol ACP](/access-paths/virtuals-acp.md) for escrow purchases; the x402 protocol; [OpenClaw](/access-paths/openclaw-skill.md) for skill-based discovery.

Your use of these dependencies is subject to their own terms. We are not responsible for their availability, security, or behavior.

## 4. Acceptable use

You agree not to:

* Use the Service for any illegal purpose, including violating applicable digital-asset laws in your jurisdiction.
* Misrepresent the source or interpretation of a SolProbe response (e.g., quoting a grade as a "guarantee" or "endorsement").
* Attempt to overwhelm, scrape around, or bypass rate limits and the x402 paywall.
* Probe for, exploit, or disclose security vulnerabilities without responsible disclosure to `dev@solprobe.xyz`.

## 5. Intellectual property

The Service — its code, design, response schemas, documentation, and the SolProbe brand — is owned by the SolProbe operator. You retain ownership of your own data and your wallet. The structured response data we return to your call is yours to use for any lawful purpose.

The `solprobe-docs` and `solprobe-skills` repositories are publicly available under their own licences; the core scanner code is private.

## 6. Privacy

We collect only what we need to run the Service:

* **Payment metadata** — your payer address, the chain, the settled amount, and the on-chain transaction hash, for revenue accounting and chargeback evidence.
* **Request bodies** — the `token_address` (and, for `/trade/execute`, the signed transaction bytes) for the duration of the call. Scanner inputs are not retained beyond the response cache TTL.
* **Operational logs** — request paths, status codes, latency, and rate-limit counters. We do not log request bodies or payment headers beyond what's necessary to settle and ship the response.

We do not sell your data and we do not have a separate analytics tracker on the API. The brand site `solprobe.xyz` may use minimal first-party analytics; see the [docs site](https://docs.solprobe.xyz) for any updates.

## 7. Disclaimers

THE SERVICE IS PROVIDED **"AS IS" AND "AS AVAILABLE"** WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SCANNER OUTPUT IS COMPLETE OR CURRENT AT THE MOMENT YOU READ IT.

A risk grade is a snapshot of structural signals at scan time. It is not a recommendation to buy, hold, or sell.

## 8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOLPROBE OPERATOR, ITS AFFILIATES, AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF DIGITAL ASSETS, LOSS OF PROFITS OR REVENUE, LOSS OF DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER UNDER CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU HAVE PAID TO SOLPROBE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) **TEN US DOLLARS (US$10.00)**.

## 9. Refunds and chargebacks

x402 payments settle on-chain and are non-reversible by us. We will, at our discretion, refund the call fee (not transactional losses) if:

* A paid scanner response returns `schema_version: "2.0"` with `data_quality: "LIMITED"` or a `5xx` failure after settlement.
* A `/trade/execute` call is settled and then rejected by the risk gate with `refundable: true` in the rejection payload.

To request a refund, email `dev@solprobe.xyz` from the wallet you paid from (or sign a message proving control) and include the on-chain payment tx hash. Refunds are paid back to the payer wallet on the same chain you paid from.

## 10. Indemnification

You agree to defend, indemnify, and hold harmless the SolProbe operator and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights — including, without limitation, any trading losses you or anyone using your wallet incurs as a result of acting on a SolProbe response.

## 11. Governing law

These Terms are governed by and construed in accordance with the laws of **Switzerland**, without regard to its conflict-of-law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in **Zurich, Switzerland**.

## 12. Modifications

We may modify these Terms at any time. Material changes will be noted in the "Last updated" date above and, where significant, called out in the docs changelog. Your continued use of the Service after the update constitutes acceptance.
